By accessing and using TuneBox (the "Service"), you accept and agree to be bound by the terms and conditions of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

TuneBox is a web-based tune collection and practice management application. The Service allows you to:

• Create and manage a collection of tunes
• Practice tunes with spaced repetition
• Sync your data across devices (when logged in with Google)
• Organize tunes with labels and sets

3. User Accounts

To use the Service, you must authenticate using Google OAuth.

You are responsible for:

• Maintaining the security of your Google account
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

4. User Responsibilities

You agree to:

• Use the Service in compliance with all applicable laws and regulations
• Not use the Service for any unlawful or prohibited purpose
• Not attempt to gain unauthorized access to any part of the Service
• Not interfere with or disrupt the Service or servers
• Not use the Service to transmit malicious code or harmful content

5. Your Content

You retain all rights to the tune data and content you create in the Service ("Your Content"). By using the Service, you grant us permission to store and process Your Content solely for the purpose of providing the Service to you.

We will not:

• Share Your Content with third parties without your consent
• Use Your Content for purposes other than providing the Service
• Claim ownership of Your Content

6. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Nikita Korobkov and is protected by international copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or distribute the Service's code or design
• Reverse engineer or attempt to extract the source code
• Remove any copyright or proprietary notices

7. Service Availability

We strive to provide reliable service, but we do not guarantee that:

• The Service will be uninterrupted or error-free
• Defects will be corrected
• The Service will be available at all times
• The Service will be free from viruses or harmful components

We may modify, suspend, or discontinue the Service at any time without prior notice.

8. Data Backup

While we make efforts to ensure data reliability, you are responsible for maintaining your own backups of Your Content. We are not liable for any loss of data.

9. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid us in the past 12 months (currently $0, as the Service is free)

10. Indemnification

You agree to indemnify and hold harmless TuneBox and its operators from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party

11. Termination

We reserve the right to terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms.

You may stop using the Service at any time. If you wish to delete your account data, please contact us.

12. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review it to understand how we collect and use your information.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last updated" date at the top of this page.

Your continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved in the courts of Massachusetts, United States.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and TuneBox regarding the Service.
